Will inform you on probe progress: CBI,state to High Court

The Central Bureau of Investigation and the State government on Monday told the Bombay High Court that it would inform the court of the progress made in investigation into the Adarsh society scam and weather the CBI had filed the First Information Report.

The Central Bureau of Investigation (CBI) and the State government on Monday told the Bombay High Court that it would inform the court of the progress made in investigation into the Adarsh society scam and weather the CBI had filed the First Information Report (FIR),or the Anti Corruption Bureau (ACB) would be required to file it as state government employees are involved.

Division Bench of Justice A M Khanwilkar and Justice A P Bhangale was hearing a petition filed by social activist Simpreet Singh pointing out that both CBI and the state police were investigating the scam and this may create issues of jurisdiction “which might hamper the probe”.

The petition demands that the probe be handed over to CBI,because the state’s Anti-Corruption Bureau “could come under pressure” since political big-wigs are involved in the scam.

Additional Solicitor General (ASG) Darius Khambhata said,“We would be seeking all the infrastructure required to investigate the case and the CBI is in the process of registering the FIR. At the moment,it would be premature to tell what would be the future course of investigation.”

Advocate General Ravi Kadam appearing for the state said,“Inquiry commission has been set up and officers will be appointed to probe the alleged irregularities of alleged top officials under the service schedule.”

However, petitioner’s advocate Y P Singh argued that unless a FIR has been registered the investigation would not be set in motion. The court adjourned the hearing till January 18.
