HC seeks police, govt reply on constable death

New Delhi : Delhi High Court on Friday issued notices to the Delhi Police, Delhi government and the Centre, seeking their responses to a writ petition alleging misconduct by the police. The petition was filed by seven persons arrested for alleged involvement in clashes between police and protesters near India Gate on December 23.

Justice G P Mittal has asked the police to file a status report on its probe into the circumstances leading to death of Constable Tomar within a week. The Ministry of Home Affairs and Delhi government have also been asked to respond to the petition.

The petition, filed by Shantanu Kumar, Amit Joshi, Kailash Joshi, Nafees, Shankar Bisht, Nand Kumar, Abhishek and Chaman Kumar, alleges that they were picked up by the police on false charges, and were not told about the charges against them till the morning after their arrest. Amit and Kailash Joshi pleaded that they were in the Delhi Metro when Constable Tomar was allegedly trampled on.

Joshi claimed that CCTV footage available with the DMRC proved that they were in the Metro.

The court has fixed the matter for hearing on January 15.
