Parliament attack case: SC dismisses Shaukat’s plea

NEW DELHI, MAY 14 : The Supreme Court on Wednesday dismissed a writ petition filed by Shaukat Hussain Guru, the convict in the Parliament attack case, challenging his 10-year imprisonment under Section 123-A of the IPC (withholding information of criminal conspiracy from police).

“In the facts and circumstances of the case, we do not find any ground to entertain the petition under Article 32 of the Constitution,” the Bench comprising Justices P P Naolekar and V S Sirpurkar said, upholding the earlier three decisions of the apex court, wherein his conviction and sentence under Section 123 of the IPC was maintained.

The court found it impermissible to grant him relief after he exhausted all the legal recourses available — challenging the High Court judgment, first the appeal, then review and finally a curative petition.

Shaukat was awarded the death sentence by a trial court which was upheld by the Delhi High Court. The apex court, however, reduced the sentence to 10-year rigorous imprisonment by absolving him of the charges of criminal conspiracy. His review petition and curative petition have already been dismissed by the SC.
