Noida hotel plots: SC issues notice to UP Govt

New Delhi, July 18: The Supreme Court on Friday asked the Mayawati Government “to look afresh” into its earlier decision of cancelling the allotment of land to several hotel companies that were allotted properties by UP’s previous Government under Mulayam Singh Yadav. The decision, however, echoes a similar one made by the Allahabad High Court and has left the hoteliers frustrated.

The companies that approached the court, including ITC and Indian Hotels Company Ltd, had been leased land for building 14 hotels in Noida ahead of the Commonwealth Games in 2006. However, Mayawati, alleging corruption in land auctions, canceled the allotments.

When the hoteliers challenged the cancellation in Allahabad High Court, it remanded the matter to the state Government for reconsideration. The hotel companies then moved the Supreme Court in hopes of a more definitive judgment in their favour.

The bench headed by Justice R V Raveendran issued notice to the state Government and the Noida Authority and also directed both parties to maintain the status quo with regard to dispossessing the allottees. The companies will present their case on August 11 before Principle Secretary, Industrial Development Department, UP. The court added that the fresh hearing should be uninfluenced by the Allahabad HC, which had criticised the earlier state Government of violating the Master Plan.

Senior advocate Harish Salve told the court that industry status does not imply that the rules of an industrial zone have to be followed. The apex court has scheduled a further hearing for the case on September 9.
