Acting on an urgent plea moved by Yamada, a Bench of Justices Arijit Pasayat and S H Kapadia agreed for a hearing at the residence despite the court being closed.
Suspending the Rajasthan High Court order, the Bench adjourned the matter until August 20 and sought response from the Union Government and Satya, a Jaipur-based NGO on whose petition the HC had directed police to produce the baby in the court.
Senior advocate Indira Jaisingh, Yamada’s counsel, contended that in view of the High Court orders, Manjhi might be taken away from the grandmother. Besides seeking urgent directions, Yamada has also sought assistance in preparing Manjhi’s travel documents.
Manji was born on July 25 after her biological parents Ikufumi Yamada and Yuki Yamada entered into a contract with a woman in Gujarat to become their child’s surrogate mother. The problem started when a month before Manji’s birth, her biological mother divorced her husband and disowned the child.
