Judge’s appointment: full-time hearing in HC

Allahabad, August 26: The hearing has begun in the case pertaining to the appointment of a Allahabad High Court judge after an objection by Additional Solicitor General of India Ashok Nigam against the petition challenging the appointment was rejected on Monday by a Division Bench comprising Justices Shushil Harkauli and Vikram Nath. The petition by advocate M C Gupta alleged that the appointment of Justice Satish Chandra was unconstitutional. Nigam had submitted that Gupta had no locus standi in the case.

On Tuesday, the Bench decided to hold full-time hearing. Till now, the petition was being heard for only two hours in the post-lunch session.

The petition says the information on the official HC website about Satish Chandra were scanty, as compared to the information available on other judges. Only one relevant fact revealed on the website regarding Satish Chandra was that he had worked as a judicial member of the Income Tax Appellate Tribunal. It also says his career profile is full of gaps and loose ends. For instance, it does not mention as to from where he obtained his LLB, LLM or LD degrees. It also does not throw any light on his career as an advocate.

In his petition, Gupta alleged that Satish Chandra had neither put in 10 years of practice as a High Court advocate nor had he held a judicial office under the High Court, as per the norms of the Constitution.
