BMW hit-and-run case: Prosecution seeks 10-yrs jail for Nanda

New Delhi, September 3:: The prosecution in the BMW hit-and-run case on Wednesday sought the maximum punishment of 10 years' jail term for Sanjeev Nanda in a Delhi court, which held him guilty for mowing down six persons including three policemen with a BMW car in 1999.

"Deterrent punishment is need of the hour, so that a right message is sent across the society to all future potential offenders," Public Prosecutor Rajiv Mohan submitted before Additional Sessions Judge Vinod Kumar.

During arguments on quantum of sentence, the prosecutor referred to the adverse findings of court against Nanda in its judgement delivered on Tuesday.

"According to the findings, criminal justice system has been tampered with by the mighty accused, who resorted to every unfair ways to botch up the trial. Hence, deterrent punishment of 10 years jail term be given to him so that in future, the mighty be refrained from polluting the justice delivery system," Mohan said.

The court had on Tuesday held Nanda guilty under Section 304 (Part II) (culpable homicide not amounting to murder) of the IPC for killing six persons with a BMW car on the wee hours of January 10, 1999 at Lodhi Road in south Delhi.

He also referred to the conduct of Nanda during and after the incident saying, ‘the drunken convict was driving the car at an excessive speed. After the incident not only he fled away but also tried to cause disappearance of evidence.’

Opposing the contentions of the prosecutor, Nanda's counsel Ramesh Gupta pleaded, "It was a case of media trial. Some sections of the media projected Nanda as a culprit from the very beginning. In case of acquittal in this case, they could have said that it was a miscarriage of justice."
