In a setback for suspended IPL Chairman Lalit Modi,the Bombay High Court Thursday refused to grant relief in his challenge against BCCI’s disciplinary proceedings ahead of the Cricket Board’s Disciplinary Committee meeting on July 16. Paving the way for the disciplinary proceedings to proceed against Modi,the court dismissed his petition and also left the question of reconstituting the members to be decided by the panel.
Modi had sought for reconstitution of the committee since he did not expect a fair and honest inquiry as he felt the committee was biased against him.
Division bench of Justice B H Marlapalle and Justice Roshan Dalvi however were of the view that Modi can challenge the final finding of the committee if it is adverse against him and he can even raise the issue of constitution of the committee at that point.
The court held that disciplinary committee has limited powers since it is only required to inquire into charges and submit the final report to the board.
“The board is the final decision-making body,” the court said. Modi had moved court after he was summoned by the committee which is going to meet on July 16. Stating that he is not averse to the inquiry,Modi had urged the court to constitute an independent body for conducting inquiry instead of the present disciplinary panel of Arun Jaitley,Jyotiraditya Scindia and Chirayu Amin,IPL’s interim Chairman.
Modi had alleged that the actions of BCCI Secretary N Srinivasan “were actuated by bias against Modi”.
